4.  To be able to sign the Public Deed the Notary will require, apart from the bank certificate, a certificate issued by the administration of the company stating that an annual general meeting has taken place and that the majority of the shareholders agreed to the increase of the social capital.
5.  On the day of the signing the administration of the company, and if possible, the shareholders presence will be required to sign the Public Deeds on the extension of the social capital of the company.
6.  Within  a period of thirty (30) working days from the signing of the Public Deeds a tax of one per cent of the extended social capital of the company has to be paid to the Junta de Analucia.
7.  When the taxes have been paid and the Public Deeds signed they will be submitted to the relevant Company House for analysis of the legalities of the documents for acceptance (or not) of the extension of the capital.
8.  If the documentation is accepted the extension of the capital of the company will be registered in the Company House corresponding to the local area of the company.
9.  If the documentation is not accepted, Company House will put in writing the legal reasons for their decision not to accept the increase in the capital of the company.  Based on this information it will be necessary to sign a document on the rectifications at the office of the Notary. These new documents will then be presented again the to Company House for their acceptance.
10. When the Public Deeds are accepted by the Company House the capital of the company will be legally increased.  One of the main functions of Company House is to provide public Company Law information to whoever might request it.  On this basis, anyone can go to Company House and request information about the accounts, administrators or capital of a company.

Therefore, after the acceptance of the extension of the capital of a company anyone can request public information concerning a particular company from
Company House and it will stand that the social capital of the company is as a result of the legal consequences of these dealings.

When a company is created one  the the corner stones of the constitution is that is is necessary to derermine the social capital.  A certificate from the company´s bank is required to establish the amount of capital owned by each shareholder and the total capital of the company. This certificate is used in the Public Deeds on the constitution of the company to define their social capital.
Based on this information and using it to develop a parallel to define the process, the legal steps are as follows:-
1.  Funds for the extension of the social capital of the company need to be transferred into the company bank account.
2.  The company bank will issue a certificate signed by the branch manager stating the capital figure and the N.I.E. number of the person who made the transfer.
3.  With this certificate it will be necessary to go to the Notary to sign the Public Deeds on the extension of the social capital of the company.
